SPORTIEPAWS TERMS OF SERVICE Last updated: [DATE] Version: 1.0 These Terms of Service ("Terms") govern your access to and use of SportiePaws (the "Service"), operated by [Legal Entity Name] ("SportiePaws," "we," "us," or "our"). By creating an account, you agree to be bound by these Terms. If you do not agree, do not create an account or use the Service. 1. WHAT SPORTIEPAWS IS SportiePaws is a technology platform that helps competitors register for dog sports trials (e.g. AKC, ASCA, and UKI agility events) and helps event organizers and their secretaries manage those events — registrations, run schedules, live queues, scoring, and results. SportiePaws is not a dog sports organization, does not sanction or officiate events, and is not a party to the relationship between a competitor and an event organizer. Each event is hosted and run by its own independent organizer/club, who is solely responsible for the conduct, safety, judging, and rules of that event. 2. ELIGIBILITY AND ACCOUNTS You must be at least 18 years old to create an account. If you are entering a junior handler (under 18) in an event, you must do so as the junior handler's parent or legal guardian, and you are responsible for that junior handler's information and participation. You are responsible for maintaining the accuracy of your account information (name, contact details, dog information, membership IDs) and for safeguarding your account credentials. You are responsible for all activity that occurs under your account. 3. EVENT REGISTRATION AND ENTRIES When you register a dog for an event through SportiePaws, you are entering into an agreement with the event organizer, subject to that organizer's own rules, entry requirements, and any event-specific legal agreement or liability waiver presented to you at the time of entry. SportiePaws facilitates that registration but does not control an organizer's entry requirements, run assignments, scoring decisions, or event-day operations. Some registrations may be entered on your behalf by an event secretary (for example, at ringside or over the phone). Where that happens, you may be able to "claim" that registration later by linking it to your SportiePaws account using the same email address the registration was created with. 4. EVENT PUBLISHING AND SANCTIONING VERIFICATION Where an event's governing organization (e.g. AKC, ASCA, or UKI) requires that an event be sanctioned, approved, or otherwise officially listed before it can take place, the event organizer must, prior to publishing the event on SportiePaws, provide a link to that event's official listing on the governing organization's own website. Publishing an event makes it immediately visible to and open for registration by competitors — either upon publishing or once the event's sign-up period opens, whichever applies — before SportiePaws has independently confirmed the event's sanctioning or approval status. SportiePaws will review the listing provided by the organizer to confirm that status and to cross-reference the club name and event secretary against the information on file for the event. If SportiePaws is unable to confirm that the event is sanctioned, approved, or official, SportiePaws may temporarily unpublish the event and contact the organizer directly to resolve the discrepancy. SportiePaws aims to complete this review, and to reach out if there is an issue, within 24 hours of the event being published; if the organizer does not hear from SportiePaws within that window, no further action is needed on their part. If SportiePaws determines that an event is not in fact sanctioned, approved, or official, and that the organizer knowingly provided an inaccurate or fraudulent listing in order to circumvent this requirement, the organizer will not be entitled to a refund of any publishing or platform fees paid for that event (see Section 5), and SportiePaws may suspend the organizer's account and/or the associated club's registration on SportiePaws (see Section 8). 5. PAYMENTS, FEES, AND REFUNDS Entry fees and other charges are processed either electronically through our third-party payment processor, Stripe, or, where an organizer accepts it, by cash or other manual payment methods recorded by the event secretary. SportiePaws does not store your full payment card details — those are handled directly by Stripe in accordance with its own terms and privacy practices. Refunds, entry changes, and cancellations are determined by the event organizer's own policies, not by SportiePaws. Where an organizer issues a refund, SportiePaws will reflect that refund in your registration record and, for electronic payments, may facilitate the refund transaction through Stripe. SportiePaws is not a party to, and bears no responsibility for, payment disputes between a competitor and an event-hosting organizer, and does not guarantee that any particular refund will be issued. Event organizers may also be charged a separate platform fee by SportiePaws for creating and publishing events; those fees are billed to the organizer, not the competitor, and are not covered by this section. Fees paid to publish an event that is later found to be based on an inaccurate or fraudulent sanctioning listing are non-refundable, as described in Section 4. 6. LIABILITY DISCLAIMER Participation in any dog sports event listed on SportiePaws — including travel to, attendance at, and competition in that event — is solely at your own risk and the risk of your dog. SportiePaws shall not be held liable for any injuries, accidents, illness, property damage, or other loss or damage sustained by any person or animal in connection with an event, whether occurring before, during, or after the event, or at any facility where an event is hosted. SportiePaws' role is limited to providing a technology platform for registration, scheduling, and event management. We do not organize, sanction, supervise, or otherwise control any event, and we make no representations about the safety, accuracy, or conduct of any event or event organizer. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, AND SPORTIEPAWS' TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT OF FEES YOU PAID TO SPORTIEPAWS (NOT INCLUDING AMOUNTS PAID TO EVENT ORGANIZERS) IN THE TWELVE MONTHS PRECEDING THE CLAIM. 7. USER CONDUCT You agree not to: provide false information about yourself, your dog, or your eligibility for an event; use the Service to harass, threaten, or abuse another user, competitor, organizer, or secretary; attempt to interfere with the security or proper functioning of the Service; or use the Service for any purpose other than legitimate dog sports registration and event management. 8. TERMINATION We may suspend or terminate your account if you violate these Terms, provide fraudulent information, or misuse the Service — including, as described in Section 4, providing an inaccurate or fraudulent event sanctioning listing to circumvent our publishing verification process. You may stop using the Service and request deletion of your account at any time, subject to our Privacy Policy and any recordkeeping obligations tied to completed event registrations and payments. 9. CHANGES TO THESE TERMS We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and version number above, and, where required by law, ask you to re-accept the updated Terms before continuing to use the Service. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms. 10. GOVERNING LAW These Terms are governed by the laws of [State/Jurisdiction], without regard to its conflict-of-laws principles. 11.
